Scalia on Guantanomo

The U.S. Supreme Court decided today that Guantanamo detainees can challenge their imprisonment. Of course, Justice Antonin Scalia desented:

Scalia said the nation is "at war with radical Islamists" and that the court's decision "will make the war harder on us. It will almost certainly cause more Americans to be killed."

I watched a 60 Minutes interview with Scalia a while back, and he came off as very principled, saying that he was sticking strictly to the law. But look at his words here. It's classic the classic ends-justify-the-means argument. Using that reasoning, would Scalia find it legal for cops to lock up anyone that looks like a troublemaker without evidence or due process because it might save lives?

Scalia needs to go on more hunting trips with Dick Cheney. They really are two peas in a pod.
